The magic number is 44: Anyone scoring above 44 points "must" be sentenced to state prison under the Code. However, the plea bargaining process can a) reduce the number of counts charged, b) have an agreement not to score certain items, c) substitute charges, d) reduce the actual count charged, or e) several other creative techniques can be used to get someone sentenced to a non-incarcerative sentence. Note the departure grounds under Rule 3.992(b), but also note the actual language of the "Sentence Computation" because someone charged with a felony can be sentenced to state prison even if the score fewer than 44 points. REASONS FOR DEPARTURE - MITIGATING CIRCUMSTANCES

(reasons may be checked here or written on the scoresheet)

_ Legitimate, uncoerced plea bargain.

_ The defendant was an accomplice to the offense and was a relatively minor participant in the criminal conduct.

_ The capacity of the defendant to appreciate the criminal nature of the conduct or to conform that conduct to the requirements of law was substantially impaired.

_ The defendant requires specialized treatment for a mental disorder that is unrelated to substance abuse or addiction, or for a physical disability, and the defendant is amenable to treatment.

_ The need for payment of restitution to the victim outweighs the need for a prison sentence.

_ The victim was an initiator, willing participant, aggressor, or provoker of the incident.

_ The defendant acted under extreme duress or under the domination of another person.

_ Before the identity of the defendant was determined, the victim was substantially compensated.

_ The defendant cooperated with the State to resolve the current offense or any other offense.

_ The offense was committed in an unsophisticated manner and was an isolated incident for which the defendant has shown remorse.

_ At the time of the offense the defendant was too young to appreciate the consequences of the offense.

_ The defendant is to be sentenced as a youthful offender.

Pursuant to 921.0026(3) the defendant’s substance abuse or addiction does not justify a downward departure from the lowest permissible sentence.
